In an article in the Harvard Journal of Sports and Entertainment Law, Indiana University’s Jayma Meyer and Smith College’s Andrew Zimbalist propose a federal framework to pay student athletes for use of their name, image, and likeness. Under this framework, universities could profit from using this information for limited purposes, such as promoting athletic events and selling official team apparel. Athletes could then enter into endorsement deals with third parties if the agreement does not conflict with the schools’ right to use their images. Congress to establish an independent commission to regulate these payments.

School funding issues are a major problem with direct links to student achievement levels. Schools with smaller budgets, which often can’t offer small classes and better programs, see lower student achievement, creating a socioeconomic in education. Beyond legislative efforts, federal authorities are granting wide latitude on billing Medicaid for using telehealth to deliver services and urging states to expand offerings. This allows students to receive special education services or visit health providers virtually, using a smart phone or computers, without risking a visit to an office or hospital. In addition, DeVos launched a $180 million "Rethink K-12 School Models" competitive grant program, designed to focus on helping states and families with virtual learning and the needed technology particularly during the Covid emergency.

A 2017 NCAA survey revealed that Division I athletes dedicate an average of 35 hours per week to their sport during the season. Before we dive into the debate over paying student-athletes, let's be clear about the NCAA's position. Its regulations state, "You are not eligible for participation in a sport if you have ever ever … taken pay, or the promise of pay, for competing in that sport … used your athletics skill for pay in any form in that sport." Billions of dollars are swirling around college sports, and everyone is getting a piece of the action. The top 25 football coaches take home an average of $5.2 million, while the top 25 basketball coaches bring in $3.2 million. In 41 states, the highest-paid public employee is a football or basketball coach.
